THE CAVE TERMS OF ENTRY AND PARTICIPATION
The Cave Terms of Entry and other conditions are implemented for the enjoyment, protection and safety of all guests (including, players, spectators or parties accompanying or responsible for a player) at The Cave. Any failure to abide by our Terms of Entry and other conditions (and instructions) may result in a guest/player incurring costs and/or at the discretion of The Cave, the immediate termination, without refund, of the entertainment experience.
By checking in at The Cave, or making an online or phone/text booking, guests are deemed to have read, understood, agreed to, and accept:
To pay in full for the booked activity before commencing and participating. The player or parties accompanying or responsible for a player are not eligible for a refund if the booked entertainment session cannot be completed due to any health and safety, wellbeing or other hazard or risk associated with use of Virtual Reality/Simulators (as set out below), to the player or any third party, or player damage to any of The Cave equipment/property; and
All guests must be 8 years old or older. (We reserve the right to request proof of age); and
Anyone, who in The Cave’s reasonable opinion, is under the influence of any drug, other narcotic or alcohol will not be permitted entry; and
All guests and players (including spectators or parties accompanying or responsible for a player) must respect The Cave staff, their instructions, other guests, and all The Cave equipment; and
All guests and players (including spectators or parties accompanying or responsible a player) must wear clean footwear and have a good standard of hygiene; and
A guest/player will fully compensate The Cave for any damage caused by it to any equipment/property/or other The Cave facility, or damage to or loss of any third party property for which the Cave is held to be responsible; and
All guests (including spectators or parties accompanying or responsible a player) agree to waive any liability, direct or consequential, to The Cave for any damage or loss of personal belongings while participating in any of The Cave activities in accordance with the general waiver and release of liability below; and
The Cave fully reserves the right to deny any guest, individual or other party (including spectators or parties accompanying or responsible a player) entry to the Cave or participation in its activities; and
The Cave:

Do not enter The Cave if you:
Feel physically ill or very tired
Are under the influence of alcohol or drugs, narcotics, or hung-over
Are stressed or anxious
Are susceptible to light-sensitive health conditions
Risks associated with use of Virtual Reality/Simulators include, but are not limited to:
Eye strain
Motion sickness
Dizziness
Nausea
Increased Heart Rate & Body Temperature
Disorientation
Vertigo
Seizures
Injury from other players
Self-Injury due to user confusion for example bumping into walls or objects, tripping, jumping or throwing, etc
While using Virtual Reality Headsets:
Flickering screens and flashing images could trigger underlying health conditions
Equipment may affect medical devices such as cardiac pacemakers etc
The media content of some experiences may affect those with pre-existing medical or mental health conditions
It is possible to feel claustrophobia, panic, or feel other phobias
Objects in the real world may not be visible in the virtual world
Objects in the virtual world may not exist in the real world
You must self monitor your health and pause or stop if you become unwell
Negative health effects may not present immediately
WARNING – Photosensitive Seizures:
Some people may have seizures or blackouts when exposed to certain visual images, such as light flashes or patterns that may appear in virtual reality, and may have an undiagnosed condition that can cause these “photosensitive epileptic seizures” while using VR . These seizures may present a variety of symptoms, including light headedness, altered vision, eye or face twitching, jerking or shaking of arms or legs, disorientation, confusion or momentary loss of awareness. Seizures may also cause loss of consciousness or convulsions that can lead to injury from falling down or striking nearby objects. Stop using the VR equipment Immediately, advise The Cave staff and consult a doctor if you experience any of these symptoms. Anyone who has had a seizure, loss of awareness, or other symptom linked to an epileptic condition, or has a relative with a history of seizures or epilepsy, should consult a doctor before using VR equipment.
WARNING – Motion Sickness:
Videos & Images like those that play during the use of virtual reality equipment can cause motion sickness in some players. If the user of a VR headset moves his or her head, that motion might not register as accurately or quickly as necessary inside the virtual environment, and any discrepancy between what the player sees and feels could lead to motion sickness. If you feel dizzy or nauseous when using the VR equipment, stop using the VR equipment and rest. Do not drive or engage in other demanding activity until you feel better. Some users have noted sustained visual effects after long use of VR headsets.
Risks and hazards include, among other things: seizures, loss of awareness, eye strain, eye or muscle twitching, involuntary movements, altered, blurred, or double vision or other visual abnormalities, dizziness, disorientation, impaired balance, impaired hand-eye coordination, excessive sweating, increased salivation, nausea, light-headedness, discomfort or pain in the head or eyes, drowsiness, decreased ability to multi-task, fatigue, or any symptoms similar to motion sickness, all of which can persist and become more apparent hours after use and which may lead to an increased risk of injury when engaging in normal activities after leaving The Cave premises.
You confirm and acknowledge that:
“You”, means you the player and includes any person for whom you are responsible, in any capacity, at The Cave
You have no prior history of epilepsy or any other neurological disorders that could affect you as a user, participant or player in The Cave facilities; and
You are not using a cardiac pacemaker, nor suffering from any cardiac or heart disorder; and
You do not have any eye disorder or other visual or visually impaired condition; and
You are not currently, nor have been during the past year, under the care of a physician or other medical practitioner for any mental, physical or neurological disorder; and
You are not under restrictive care due to pregnancy and/or in the first trimester of pregnancy; and
You have never suffered any concussion or brain injury requiring medical or other attention; and
You will immediately alert The Cave staff if you experience any of the following symptoms while at The Cave: Involuntary Movements, Disorientation, Eye or Muscle Twitching, Confusion, Dizziness, Convulsions or Nausea; and
The use of The Cave's Virtual Reality and Simulator equipment entails known and unanticipated risks that could result in physical or emotional injury, paralysis and death - to myself, the person for whom I am responsible, to property, or to third parties; and
You understand that such risks cannot be eliminated without jeopardizing the essential qualities of the entertainment activity delivered.

Our staff are trained to guide guests/players through the entertainment experiences safely and players are instructed in safe participation in the entertainment experiences and proper use of the equipment.
Damage to Equipment: Misuse of the VR/Simulator equipment including falling, throwing, hitting walls and/or other players can cause damage to the VR equipment. Inappropriate use or failing to comply with staff instructions can lead to incurred charges arising from damage.
Pee/Vomit/other gross stuff: If a guest and or player suffers an inadvertent bodily function 'accident' while in VR, the staff host must be alerted immediately and they will (discreetly) give instructions to be followed. Please do not walk through the venue. Circumstances dependent, the entertainment session may have to end early. If we are obliged to sanitise and/or mop out the affected area a clean-up fee will apply.
Loss/Damage of personal property: We cannot guarantee the safety or security of your personal belonging while using VR or Simulators at The Cave. We may suggest somewhere to put your bag/phone/wallet/glasses etc, but are not responsible for your items. We recommend leaving your personal belongings in your car or in a zipped pocket.

Due to losses arising from no-shows, we now require a payment/deposit in advance to secure/confirm a booking. Our refund policy is in compliance with the Consumer Guarantees Act.
Full refunds apply for bookings that are cancelled, rescheduled or have player numbers reduced more than 24 hours prior to the booking time. We accept notifications via the online booking system, email, text or phone.
We do not provide a refund for cancellations made less than 24 hours prior the booking. We are not obliged to, but we understand unforeseen things come up. Call us and we'll happily discuss adding a credit to your account or reschedule your booking.
This is at the discretion of the Manager and depends on availability.
We do not typically offer refunds for:
No-Shows: We will attempt to contact the booking when no one arrives at the booked time, and if no response by the end, we will process the full payment and look forward to someone calling to complain.
Incomplete Sessions: In some cases, you may not be able to complete your session. This could be due to:
Seizure
Motion Sickness
Injury
'Accident' (our staff do show all guests the bathroom on entry)
Risk of injury to self/others
Risk of damage to equipment
These rare occasions are non-refundable, but situation dependent and at our discretion, we may offer an account credit or an alternate activity.
Late arrivals: We try to compensate for late arrivals “events” (e.g. traffic) by extending your booking end time. This depends on availability. We don't provide refunds if your session is shortened due to late arrival.
Reduced guest numbers: If you book for a certain set number of players and arrive with fewer, you will be charged the original booking price as the VR/Sim is unavailable for any other bookings during the booked period. At our discretion, we may offer an account credit.
Private Events & Birthday Parties: Deposits are non-refundable for Private Events and Birthday Parties due to having to pre order catering and roster on of additional staff. At our discretion, we may offer an account credit.

Studio Surveillance: The Cave venues record video and audio at all times for training, quality control, security and promotional use. By entering The Cave, you consent to your image and/or audio to be used internally and publicly. For example, if you run into a wall, the footage can be used for an insurance claim, staff training or as a post on social media to show what happens when someone doesn't obey instructions.
Public Filming: Guests are welcome to take photos and videos and The Cave does not have any claim or control over that content, nor will it accept any liability of any nature in that respect. Please be considerate of other guests when recording your experience at The Cave, and if necessary, obtain their consent to being recorded.
You accept and agree in respect of media:
To grant The Cave the right to photograph, video and/or record me and/or my child/ward and to use my name, face, likeness, voice and appearance in connection with training and promotional materials without reservation, limitation or compensation.

I certify and confirm to The Cave:
1. I have read, understood, and agree to comply with the rules and safety precautions displayed and/or explained to me verbally relating to the simulation and VR (virtual reality) gaming and entertainment facilities and activities provided by The Cave (“the activities”). I understand that it is a condition of taking part in the activities that I must give the confirmations and certification set out below.
2. I have had the opportunity to inquire from and ask The Cave any questions that I have relating to the activities, and all information I require has been provided by The Cave.
3. I do not have any physical condition or health issues which would make it unsafe or against medical advice for me to participate in the activities.
4. I acknowledge that the activities involve simulation and VR (virtual reality) gaming and entertainment and are potentially inherently dangerous. The activities, particularly VR, can be immersive, stimulating, and mentally and physically impactful and exciting. They also may include flashing lights, videos, simulated motion and other sensations, all as described above. Careless actions or accidents within the activities carry the risk of injury and harm, as well as damage to property. These risks can arise from my own actions and the actions of other people for whom I am responsible.
5. I assume and accept all of the risks involved in participating in the activities including (by way of example and not limitation) any risk, injury, or damage that may arise, directly or indirectly, from the activities and from the equipment used.
6. I confirm and undertake on behalf of myself, my executors, administrators, and successors as follows:
a. I waive, release and discharge The Cave from all liability of any kind, for my death, disability, personal injury, property damage, or any loss of any kind which I may suffer if I take part in the activities.
b. I indemnify The Cave from any and all liabilities or claims made as a result of me taking part in the activities, from whatever cause.
c. The certifications and confirmations contained in this form are given for the benefit of and extend to The Cave, its officers, its employees, its agents and representatives and the term The Cave in this form shall include all such persons.
